It is very frustrating for ticket buyers to receive news of a cancelled show. It is also a headache for organizers to deal with the entire situation. This creates an unpleasant situation for both those who purchased tickets and those who have to refund the money. Who is responsible for this now?
According to the Consumer Defense Code (CDC), a ticket is equivalent to a service contract, the cancellation of which entitles the buyer to a refund (return of money). However, consumers should pay attention: under the CDC, the maximum period to request a refund is 30 days after a show is cancelled – and it is the organizers' duty to announce this cancellation through the same channels of information where the show was advertised.
The refund must be made in the same manner as the payment was made. If the payment was made in cash, the consumer must be refunded immediately in cash as well. If it was made by credit card, the responsible party must proceed with an immediate reversal of the amount paid with the card issuer. Service fees charged on payments made by credit/debit cards must also be refunded.
As for those responsible for refunding the amounts paid for the cancelled show, the consumer has the right to charge any of the involved companies: whether from the artists or singers, their manager, the event producers, or the ticket sales point itself. It is important to remember that, according to the Consumer Defense Code, all are responsible.
It is also important to emphasize that if any of the parties involved refuse or make it difficult to refund the amounts paid for the tickets, the consumer also has the right to be compensated for any losses they have suffered, as well as for the costs incurred to get their money back. Additionally, depending on the case, through legal means, the organizers of the cancelled show may be ordered to compensate for the moral damages suffered by the consumer.
Recently, we had some events cancelled in Vitória, but ALL online ticket buyers, made through WelcomeShop (as well as other sites managed by WelcomeGroup) received their money back without even having to request it.
With all this in mind, before buying your ticket, prefer reputable and well-known sales points, as regardless of the producer or event, sales points can facilitate the resolution of any potential issues.
