The Bill 3266/26 makes it mandatory to offer quick glucose tests — the fingertip exam — during traffic stops. The measure aims to prevent blood sugar changes from being confused with intoxication, sparing the driver from undue penalties and helping agents identify medical emergencies.
The test may be offered when the breathalyzer indicates alcohol consumption and the driver denies drinking or when there are signs that could indicate changes in blood sugar levels. The proposal is under analysis in the Chamber of Deputies.
According to the text, the use of the device will depend on the driver's consent.
The author of the proposal, Deputy Josivaldo JP (União-MA), stated that the measure does not replace the legal procedures for alcohol and other substances inspections but serves as a complementary tool.
"It adds a support tool for the preservation of life, health, and the dignity of drivers," he emphasized in justification.
Training of agents
In addition to learning how to use the devices, agents must be trained to recognize signs of changes in glucose levels and adopt procedures for medical assistance.
The project considers the information obtained from the measurement as sensitive personal data, which must comply with data protection legislation.
Next steps
The proposal will be analyzed, in a conclusive manner, by the committees on Health; Transportation; and Constitution, Justice, and Citizenship.
To become law, it needs to be approved by the Chamber and the Senate.
