Project exempts radios from punishment for signal interference

The bill 3145/26 exempts radio stations from administrative penalties, such as fines or loss of concession, for causing interference in the signals of other communication services. The measure covers interferences that occur within a radius of 100 km from the transmitting antenna. The proposal is under analysis in the Chamber of Deputies.

The author, Deputy Cezinha de Madureira (PL-SP), argues that current legislation punishes radios for technical problems that are beyond the operators' control. According to him, many interferences recorded near antennas occur due to natural factors, such as signal reflection in rocks, heavy rain, electrical discharges, or changes in the atmosphere.

"This measure provides predictability and fairness to the sanctioning regime of sound broadcasting, preventing punitive rigor from falling on unavoidable situations," defended the deputy.

He emphasizes that small and medium-sized radios are the most affected by fines, which compromise the financial viability of the business. However, the parliamentarian notes that the National Telecommunications Agency (Anatel) may continue to require measures to correct the technical problem, but without applying automatic penalties.

Under the proposal, broadcasters will continue to be punished if the interference affects frequencies used for aircraft communication or by public security agencies.

The text amends the General Telecommunications Law and the Antenna Law.

Next steps

The project will be analyzed in conclusive character by the Communication; and Constitution, Justice and Citizenship committees. To become law, it needs to be approved by the Chamber and the Senate.
