The Bill 2085/26 guarantees the right to telework or remote work for pregnant employees who are in a situation of clinical risk proven by an official medical certificate.
The text under analysis in the Chamber of Deputies also establishes priority in the allocation of remote positions for pregnant women, people with disabilities, and employees with children up to four years old.
“By guaranteeing telework to pregnant women facing clinical risks, the project favors job retention and the continuous appreciation of women in the labor market,” stated Deputy Renata Abreu (Pode-SP), author of the proposal.
Safety and health
Renata Abreu's initiative amends the Consolidation of Labor Laws (CLT). According to the deputy, the idea is to adapt the legislation to the technological reality and use remote work as a tool for safety and health at work.
According to the proposal, if the original function of the worker is incompatible with telework, the employer may temporarily change the activities performed by the pregnant woman to enable the remote format.
The temporary change of function must respect the personal condition of the pregnant woman and occur without any loss of remuneration. The proposal also guarantees the resumption of the original activity immediately after returning to in-person work.
Next steps
The project will be analyzed, in conclusive character, by the committees of Labor; Defense of Women's Rights; and Constitution, Justice and Citizenship.
To become law, it must be approved by the Chamber and the Senate.
