Expenses with education, rent, medications, and manual medical receipts can be refunded? These are just some of the main questions from those who will file their tax return.
The submission of the Income Tax Declaration has begun and this year it will go until May 30. Most taxpayers are aware that they are required to declare if they received more than R$ 33,888 in 2024, and the limit for Annual Gross Revenue for rural activities has increased from R$153,999.50 to R$169,440.00. However, many still have questions about expenses with education, rent, medications, and even about including dependents in the declaration. With this in mind, accountant and tax and fiscal benefits consultant, Emanueli Cristini, clarifies below some doubts from taxpayers. Stay tuned! 1- Can I include my parents or in-laws as dependents? Parents can be included as dependents if it can be proven that there is a financial dependency relationship. In-laws can only be included as dependents if the spouse is also claimed as a dependent on the income tax return, and in this case, it is also important to ensure that the dependency relationship can be proven if necessary before the tax authorities. 2- Does an independent worker or MEI who is subject to any of the filing obligations and has health and education expenses only need to file the return to get a refund? No. The refund refers to the amount paid in the previous year as Income Tax withheld at source. If the person did not pay income tax on the income earned in 2024, they will not have any tax to refund. 3- R$10,000 in education expenses. Can I refund everything? No. The limit for refunding education expenses is R$3,561.50 per dependent. 4- Is the amount I pay for medications deductible from income tax? No. Expenses with medications and pharmacies are not deductible expenses for Income Tax and cannot be declared. 5- Can I deduct rent from income tax? Only if the taxpayer is a self-employed professional and conducts their professional activity at home. In this case, a deduction of 1/5 of the rent paid is allowed; however, to benefit from this deduction, the income tax must be declared monthly through the carnê leão. 6- Do Brazilians living abroad need to pay income tax in Brazil? Except for exceptions, for Brazilians residing abroad who have not informed the Federal Revenue Service of their definitive departure from the country, the same rules apply as for residents in Brazil, and all income earned abroad must be converted to US dollars and declared in Brazil. 7 – I have manual medical receipts from 2024. Are they valid for this year's declaration? Yes. Since the Receita Saúde application only became mandatory from January 1, 2025, only in next year's declaration will manual receipts cease to have fiscal value for income tax purposes. The accounting office also points out that until March 30, only the submission of the declaration via computer software is allowed, and from April 1, online submission through the Meu Imposto de Renda program and the ECAC Portal (Virtual Service Center for Taxpayers) begins. “And remember that the submission date also influences the refund date. If there is a correction in the declaration, the date of the last correction made counts as the submission date. Additionally, it is worth noting that those who choose to file using the pre-filled model, even though it is valid from April 1, have priority in receiving the refund,” she clarifies.
