The law firm Amarildo Santos Advogados Associados has a new decision that came out on February 20, regarding a Writ of Mandamus about the selection process against Notice 39/2023 – from the Secretary of Education of the State of Espírito Santo - SEDU, which deals with internship scoring.
According to the lawyer specialized in Public Teaching, Amarildo Santos, in November 2023, the firm brought to the judiciary of the state of Espírito Santo a writ of mandamus that discussed the lack of equality in scoring for those who practiced internships or worked as internship students from 2013 to 2023.
According to the lawyer, the Court of Justice accepted the thesis and determined that the internship scoring be removed from the selection process on January 24.
“In November 2023, before the call, as soon as the notice was published, the firm filed the writ of mandamus, requesting that the internship scoring be removed from the qualified professionals, determining that the State of Espírito Santo and the Secretary of Education remove this internship scoring, and that they would have to redo the classification list,” he states.
The state was notified, the Attorney General's Office was also notified, and there was no response. The judge issued an order for compliance with the decision, and the State did not respond.
The firm filed a petition with two requests, asking the Court of Justice to increase the fine of R$ 500.00 that had already been applied daily, to be raised, that is, increased.
Both requests were accepted, and the fine was increased to R$ 2000.00 – with the previous fine of R$ 500.00 per day existing from January 24 to the present day. The reporting judge of the case determined compliance with the decision, under the penalty of criminal liability for the Secretary of Education of the State.
