A hot topic due to the approaching end of the year, the payment of the 13th salary is provoking discussions. Due to the extension of the government aid for companies to pay their employees for an additional two months, labor law specialist Wiler Coelho emphasizes that companies need to define how the situation of employees will be handled. “There are still many doubts regarding what will be paid, especially since the government is advising entrepreneurs to pay the full amount of the 13th salary,” he points out. However, what may happen is that some companies that opted for contract suspension or reduced hours may attempt to make reduced payments by discounting the months of activity interruption, since each month worked represents 1/12 of the salary,” explains Coelho.
“The important thing is to follow the government’s guidelines, which regulated labor situations during the pandemic – in the case of the entrepreneur – with dialogue always being the best way to avoid legal disputes,” concludes the lawyer.
